Welcome to Ventro Core (the "App"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and ROJO O VERDE LLC ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

• This is a wellness tool, not a clinical device. It does not provide medical advice.
• If you are in a crisis, stop using this app and call 911 or local emergency services immediately.
• Your journals and drawings are yours. We host them so you can sync and access them, as described in our Privacy Policy.
• Subscriptions are billed by Apple or Google. RevenueCat helps the App verify your premium access.
• You agree to use the app for its intended purpose and not to attempt to hack or scrape our content.

1. Medical and Mental Health Disclaimer

1.1 Not a Medical Service

Ventro Core provides wellness and educational content, including meditation, journaling, soundscapes, and "First Aid" decompression tools. We are not a healthcare provider. Use of this App does not create a doctor-patient or therapist-patient relationship.

1.2 No Professional Advice

The content provided is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or qualified mental health provider with any questions regarding a medical condition.

1.3 Crisis Intervention

Ventro Core IS NOT A CRISIS INTERVENTION SERVICE. If you are experiencing a medical emergency, a mental health crisis, or are considering self-harm, you must immediately contact emergency services (e.g., 911 in the US) or a dedicated crisis hotline.

2. Eligibility, Accounts, and Sign-In

2.1 Age Requirements

You must be at least 13 years of age (or 16 in certain jurisdictions, such as the EEA) to use this App. By using the App, you represent that you meet these age requirements.

2.2 Account Responsibility

If you create an account, you are solely responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use of your account.

2.3 Sign-In Methods

You may register with email and password, use Sign in with Apple, use Google Sign-In, or continue as a Guest. When you use Apple or Google sign-in, you also agree to the applicable terms and privacy policies of those providers. Guest accounts may be upgraded to permanent accounts as described in the App.

2.4 Guest Accounts

Guest sessions provide limited access without a permanent email and password. Guest data is stored on our servers under a temporary account. If you delete the App or do not upgrade, you may lose access to guest progress unless you sign in again with the same guest session where supported.

3. User-Generated Content (Journaling & Drawings)

3.1 Ownership

You retain full ownership of any text, drawings, or data you create within the App ("User Content"), subject to the license below.

3.2 License to Host

To provide our services (e.g., syncing your data across devices), you grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and back up your User Content. This license is strictly for the purpose of operating the App and is governed by our Privacy Policy.

3.3 Privacy

Your journaling and drawings are treated as sensitive User Content and are protected as described in our Privacy Policy. We do not sell your personal reflections to third parties.

4. Subscriptions and Payments

4.1 Billing

Paid subscriptions are sold and billed through your platform's in-app purchase system: Apple's App Store on iOS and Google Play on Android. When you subscribe, payment is charged to the Apple ID or Google Play account associated with the device, and renewals continue automatically for successive billing periods until you cancel. We use RevenueCat to manage subscription entitlements in the App; RevenueCat does not process your payment card directly.

You can manage or cancel your subscription at any time from Profile → Subscription, which opens the App Store or Google Play subscriptions page for this app, or directly in your platform settings.

4.2 Free Trials and Promotions

If a free trial or promotional offer is available, its duration and eligibility are shown at purchase. Unless you cancel before the trial ends, you may be charged automatically when the trial converts to a paid subscription according to the store's rules.

4.3 Refunds

Refund and billing dispute requests are handled by Apple or Google in accordance with their store policies and applicable law. To request a refund, use Apple's "Report a Problem" page or Google Play's order history. If you have a billing question, contact us at contact@ventro-core.com and we will help where we are able.

5. App Features and Permissions

5.1 Soundscapes and Background Audio

The Soundscapes feature allows you to mix and play ambient audio. On supported devices, audio may continue playing when the App is in the background or the screen is locked, consistent with your device settings and the App's background audio capability.

5.2 Notifications

The App may send push notifications if you enable them. You can turn notifications off in the App or in your device settings.

5.3 Microphone and Media

Certain optional features (such as Zen Pet voice notes) require microphone or photo access. You may decline permission; those features will not be available without it. Use of the microphone and photo library is described in our Privacy Policy.

6. Third-Party Services

The App integrates third-party services to operate, including analytics (PostHog), push delivery (Firebase), subscription management (RevenueCat), marketing measurement (Meta App Events), and sign-in or billing through Apple and Google. Your use of those services may be subject to their respective terms and privacy policies, as described in our Privacy Policy.

7. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use any automated system (bots, scrapers) to harvest content or data.
• Use the journaling or other features to store or transmit illegal, harassing, or harmful content.
• Circumvent or bypass any security features, paywalls, or regional restrictions.
• Misrepresent your identity or impersonate another person when creating an account.

8. Limitation of Liability and Indemnification

8.1 "As Is" Basis

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the App will be error-free or uninterrupted.

8.2 Limitation

To the maximum extent permitted by law, ROJO O VERDE LLC shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the App.

8.3 Indemnity

You agree to indemnify and hold us harmless from any claims arising out of your breach of these Terms or your misuse of the App.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. You agree that the state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising from these Terms or your use of the App, and you consent to personal jurisdiction there.

10. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will post the updated Terms in the App and update the "Last Updated" date above. Your continued use of the App after the effective date of the changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the App.
